This Privacy Policy has been crafted to inform users as to how we collect, store, use, manage, process, transfer, and implement any other possible operation to the personally identifiable information (“Data” ) that users provide during the use of our services.
If you do not agree to the processing of your Data in the way that this privacy policy describes, please do not provide your information (when we request) and stop using the APP or any services associated with the APP (“Services” ). By using the Service, users are explicitly and specifically agreeing to the collection, use and any other ways of operation of their Data as outlined in this Privacy Policy. We may amend the Privacy Policy from time to time according to the relevant laws, users can find the updated Privacy Policy on the website of DigitalConch as well as on the APP. We will notify users if we make any material changes to the Privacy Policy. Unless specifically notified to us, users are deemed as agreeing to any amendment made by us.

1. Data and How we Collect them
We collect or receive Data in three ways:
(1) you directly provide Data to us, such as by creating an account or signing up for email alerts.
(2)we collect Data on an ongoing basis, such as through cookies and related technologies.
(3) we receive Data from third party with your consent, such as social media platforms.
1.1 Data You Provide to Us
You may provide your Data to us when you choose to use our Service. As we change our offerings and features from time to time, the Data we collect from you may vary depending on the services you are using. If you provide the Data to us, it will be construed as your acceptance to use our Service and consent for providing the Data. However, you do not have to provide Data when we ask you for it, but if you decline you might not to be able to access or enjoy Services or certain services, offering or features.
In general, we collect Data and other information as set forth in the table below for specific purposes:

Registration information, such as your user identifier, nickname, password, gender, date of birth, phone number (or email, if applicable),and language;

Profile information, such as your alias, profile images, hometown, self-introduction, social media information, education, and career;
(3)
User-generated contents (“UGC”), such as comments, texts, messages, pictures, images, videos, sounds, code or other data or materials that you upload, distribute or stream on the App when you use DigitalConch Services;
(4)
Facial data, if you utilize Real-Person Profile Picture Authentication, we collect your profile picture and facial-recognition video for Real-Person Profile Picture Authentication on the premise of your approval by comparing your profile picture with face-recognition video. This authentication can protect you from impersonators and fake accounts, or develop the authenticity of DigitalConch Services. We will not use it for other purposes unless we have obtained your explicit consent or turn this into de-identified data.

Payment information, such as bank account number, Paypal or other payment information where required for payment;

Transaction information,such as the transaction serial number and transaction historical records after you purchased Paid Services;
(7)
Your Global Positioning System (GPS) information, after you permit us to do so but you may change the access to your GPS information via the settings on your mobile device;
(8)
Your opt-in choices and correspondence with us, such as information used to verify with your account or to resolve your feedback or complaints; and
(9)
Information you provide when participating in in-app surveys and activities.
1.2 Data We Collect On an Ongoing Basis
We may also collect Data and other information through technologies, from you when you use our Services. We use these Data and information for purposes such as modifying or improving features, managing advertising, addressing technical issues, preventing fraud, and conducting data analytics and it is necessary for provision of Service. The type of information that we collect may vary, but generally includes:

- Performing the obligations under Terms of Use and providing our Services;
- Your and our legitimate interests;
- Necessity for protecting the vital interests of you;
- Other legal reasons including if required under any law or required by governmental and regulatory bodies.
We collect, use, store, and process your Data to operate our business and to enhance and personalize your social experience, such as:
- Software:identify, fix, and troubleshoot bugs and service errors; provide software updates.
- Provision of services: to present DigitalConch Services and its contents to you, including any interactive features on DigitalConch Services, and to provide you with information, products or services that you allow us to; we also collect and use Personal Information to verify your eligibility and deliver prizes in connection with promotion activities and sweepstakes;
- Improvement of services: to improve and personalize our services by presenting new services, information, recommendations, and feedback;
- Communication: to communicate and interact with you directly, for an example, we may send notifications regarding upcoming changes, promotion activities or improvements on DigitalConch Services;
- Content review: to review pictures, images and contents posted or generated on DigitalConch Services to ensure that we comply with any applicable content regulations in any relevant jurisdiction;
- Customization of content: to perform research and analysis about your use of, or interest in contents, products, advertising, or services available on DigitalConch Services in order to develop and display content tailored to your interests on our Website and App;
- Performance Analysis: to determine whether users of DigitalConch Services are unique, or whether the same user is using DigitalConch Services on multiple occasions, and to monitor aggregate metrics such as total number of visitors, number of viewed, demographic patterns;
- Functionality and security: to identify users not meeting the age limit, to diagnose or fix technology problems, and to detect, prevent, and respond to actual or potential fraud, illegal activities, or intellectual property infringement;
- Compliance: help identify fraud and illegal behavior, to enforce our terms of use and to comply with our legal obligations;
- Marketing/Advertising:serve and measure the effectiveness of advertising; adhere to your preferences and to deliver dynamic content
- Aggregation: to aggregate information we collect about you to which one or more purposes described above.
- Cookie: We and our vendors and service providers use cookies and other similar technologies (e.g., web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze which web pages you click on and how you use the Platform, enhance your experience using the Platform and improve our services. Cookies are small files which, when placed on your device, enable the Platform to provide certain features and functionality. Web beacons are very small images or small pieces of data embedded in images, also known as “pixel tags” or “clear GIFs,” that can recognize Cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. By using the Platform, you consent to our use of Cookies.
You may be able to refuse or disable Cookies by adjusting your browser settings. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of Cookies. In addition, your opt-out selection is specific to the particular browser or device that you are using when you opt out, so you may need to opt-out separately for each of browser or device. If you choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to you.
To provide you support, including to:

Help identify and troubleshoot problems with your account or APP;
- To survey your opinions through surveys or questionnaires;
- Communicate with you and respond to your specific requests or questions;
- Help you find your friends or share your related social experience;
- Manage and send you confirmations and important information about your account, purchases, subscriptions, and warranties.
Note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we use your Personal Information.
2.2 Sharing Your Data
- Please note that if your profile is public, your content will be visible to anyone on the Platform and may also be accessed or shared by your friends and followers as well as third parties such as search engines, content aggregators and news sites.
- We may also share your information with other members, subsidiaries, or affiliates of our corporate group, to improve, optimize the Platform and to prevent illegal use.
- We may share your Personal Information outside of DigitalConch Services when we have your consent, either express or implied.
- We may disclose your Personal Information to members of our corporate group (that is, entities that control, are controlled by, or are under common control with us) to the extent this is necessary for services, customer management, customization of content, advertising, analytics, verifications, functionality and security, and compliance.
- We may disclose or share your Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by us about our users is among the assets transferred. If such a sale or transfer occur, we will use reasonable efforts to try to ensure that the entity to which we transfer your Personal Information uses information in a manner that is consistent with this privacy policy.
- We access, preserve and share your Personal Information with regulators, law enforcement or others where we reasonably believe such disclosure is needed to (a) comply with any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms of use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address illegal or suspected illegal activities, security or technical issues, (d) protect against harm to the rights, property or safety of our company, our users, our employees, or other third parties; or (e) to maintain and protect the security and integrity of DigitalConch Services or infrastructure.
- We may disclose aggregated information about our users. We also may share aggregated information with third parties for conducting general business analysis. This information does not contain any Personal Information and may be used to develop content and services that we hope you and other users will find of interest.
- We may disclose your Personal Information to our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, customization of content, analytics, security, map navigation, data storage and cloud services, supporting our functionality, and other features offered through DigitalConch Services. These service providers may have access to Personal Information needed to perform their functions and operate under their own privacy policies and their terms of service, but they are not permitted to share or use such information for any other purposes. However, if you connect to a third-party service through DigitalConch Services or otherwise links your DigitalConch account with a third-party service, you are requesting and authorizing us to share or grant access to information on your behalf with such third party. We may also send information about the content that you watched or your activities on DigitalConch Services to such third party in order to upgrade your experience on DigitalConch Services. We encourage you to check their privacy policies to learn more about their data processing practices and exercise due caution while accessing any third-party website which is beyond our control.
2.3 Data transfers
Our Service is global by nature and your Data can therefore be transferred to third parties or service providers or business partners located within or outside your jurisdiction. You hereby unconditionally agree and permit that we may transfer, share, disclose all or any of your Data to third parties or service providers or other entities where necessary in relation to the purposes identified in this Privacy Policy. In accordance with applicable data protection and privacy laws and regulations, we will implement appropriate measures to ensure that your personal information remains protected and secure when it is transferred outside of your country to a jurisdiction that has a less adequate level of protection of personal data. These measures include (where applicable) transferring pursuant to data transfer agreements implementing standard data protection clauses, such as our partners may use include standard contractual clauses approved by EU Commission or other jurisdictions.
We may also transfer your personal information outside of your country as permitted by applicable data protection and privacy laws and regulations. Examples include where we need to transfer your personal information: (a) to perform a contract with you (or to take steps before the contract at your request); (b) perform a contract in your interests; or (c) in relation to legal claims.
2.4 Data Security
We take appropriate administrative, technical and physical security measures to safeguard your Personal Information from unauthorized access and disclosure. For example, only authorized employees are permitted to access Personal Information, and they may do so only for permitted business functions. In addition, we use encryption in the transmission of certain your Personal Information between your system and ours, and we use firewalls to help prevent unauthorized persons from gaining access to your Personal Information. Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of your Personal Information. You should use caution whenever submitting information through DigitalConch Services and take special care in deciding which information you provide us with.
You are responsible for maintaining the secrecy of your password and account information at all times.
3.Your Rights and Options
You may exercise any of the rights described in this section by using any functionality available while using the Service and/or sending an email
viaprivacy@digitalconch.com and we will respond within 30 days. Please note that we may ask you to verify your identity before taking further action on your request.
3.1 Managing Your Data
You may access and update some of your Data through your Account settings. If you have chosen to connect your Account to a third-party application, such as Facebook, you can do so within the APP. You are responsible for keeping your Data accurate and up-to-date.

3.2 Rectification of Inaccurate or Incomplete Data
You have the right to review your Data provided to us, ask us to correct any inaccurate or incomplete personal Data concerning you. Should you have such requirement, please contact us in accordance with clause 7 of this Privacy Policy.
3.3 Data Access
In some jurisdictions, applicable law may entitle you to request copies of your Data held by us. You may also be entitled to request copies of Data that you have provided to us in a structured, commonly used, and machine-readable format, should you have such requirement, please contact us in accordance with clause 7. For providing such copies, we may charge a reasonable fee based on administrative costs incurred thereupon and your requests to such copies shall not adversely affect the rights and freedoms of others.
3.4 Withdrawing Consent and Restriction of Processing
Where you have provided your consent to the processing of your Data by us, you can always withdraw your consent at any time. For example:
- You can make changes to your information, including accessing your information, correcting or updating your information or deleting your information by editing your profile in the App.
- You can switch off GPS location, Microphone, Camera or other similar functions on your mobile device if you do not wish to share them. You can also hide your location, recent active time and other information by adjusting “Privacy” setting, but that may result in you being unable to use certain features of DigitalConch Services.
- You can choose not to provide us with Personal Information, but that may result in you being unable to use certain features of DigitalConch Services because such information may be required for you to register as a user, purchase Paid Services, participate in a promotion, survey, sweepstakes or make complaints.
- You can at any time request to opt out from allowing us to send you push notifications by adjusting the permissions in your mobile device.
- You can change the mobile advertising identifiers in your mobile device or limit advertising tracking through your mobile device’s privacy settings.
- You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. Please note that your choice to disable cookies will be specific to the particular browser or device that you are using when you disable cookies, so you may need to separately disable cookies for each type of browser or device. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.
Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.
Additionally, in some jurisdictions, you have the right to object and/or limit the ways in which we use your Data, in particular where:
(i)you contest the accuracy of your Data;
(ii)the processing is unlawful and you oppose the erasure of your Data;
(iii)we no longer need your Data for the purposes of the processing, but you require the Data for the establishment, exercise or defense of legal claims.

3.5 Data Retention and Erasure.
We generally retain your Data for as long as is necessary for the performance of our service and to comply with our legal obligations and then it is deleted or erased based on our internal protocols.
If you no longer want us to use your Data to provide our Service to you, you can request that we erase your Data and close your Account.
In certain jurisdictions, you can request to have all your personal information deleted entirely. Please note that if you request the erasure of your personal information:
If you ask us to remove or delete your Data, we may retain your Data as necessary for our legitimate business interests, such as to comply with our legal obligations, resolve disputes, and enforce our agreements.
We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety. For example, if we suspend an Account for fraud or safety reasons, we may retain certain Data or information from that Account to prevent that member from opening a new account in the future.
We may retain and use your personal information or Data to the extent necessary to comply with our legal obligations. For example, we or third parties engaged by us may keep some of your information for tax, legal reporting and auditing obligations.
Information you have shared with others may continue to be publicly visible in the APP, even after your Account is cancelled. However, attribution of such information to you will be removed. Additionally, some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers. Data protection and information security is important for us. While providing services to you and other users, we operate and maintain the Services or APP so as to protect Data and our systems from accidental or malicious loss and destruction. Therefore, as part of provision of Service and on account of overall safety of Data of all users, residual copies of your personal information may not be removed from our backup systems for a limited period of time.
3.6 Objection to Processing
In some jurisdictions, applicable law may entitle you to require us not to process your Data or personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing, we will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defence of legal claims.
Where your personal information is processed for direct marketing purposes, you may, at any time ask us to cease processing your data for these direct marketing purposes in accordance with clause 7.
4.How We Protect Personal Data
4.1 Security Safeguards
We have implemented reasonable security practices and standards and documented information security policies comprising of all relevant security control measures that are commensurate for protection of the information assets (including your data). We shall also comply with audit requirements as may be required under applicable law. The company’s service provider responsible for hosting of Data has implemented ISO/IEC 27001:2013 standards for its management system and we work with our service providers to ensure that adequate security measures are taken to afford protection to your Data.
Security of our users' Data is a priority at us, and we are continuously implementing and updating administrative, technical, and physical security measures such as access control, compressed encryption to help protect your Data against unauthorized access, loss, destruction, or alteration. However, in a digital world, you will appreciate that we cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. This means we cannot guarantee the security of your Data and do not assume any responsibility for the unauthorized use or access to your Data under our control.
If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. If there is a security breach occurs, we may also post a notice on the Website. We will send an emergency report to authorities in case that the security breach is serious and assist authorities to take steps to prevent further harm.
If you know or have reason to believe that your Account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your DigitalConch Account, please contact us in accordance with clause 7, and we will proceed with it within 30 days and respond to you as soon as possible when we have any update.
Please keep in mind that whenever you voluntarily disclose Data online through certain channel (for example on message boards, through email, or in chat areas), that Data can be collected and used by others. We will take no responsibility whatsoever caused by reasons said above. Since disclosure of personal Data through certain channel may lead to disclosure of your personal Data, we remind you to use caution before sharing or making such disclosures. Ultimately, you are solely responsible for maintaining the secrecy of your passwords or any account Data. Please be careful and responsible whenever you are online.
5.Children
Our Service is not intended for children. Children must not use the Service for any purpose. By children, we mean users located in this country and who are below the minimum age, are required to obtain parental/guardian consent prior to the using the APPs. If you are under the minimum age, you are not permitted to access the websites or APPs unless your parent or guardian has provided express consent and accepts this Policy prior to the using the APPs.
We do not knowingly collect or maintain personal information from persons under 18 years-of-age(namely, children). If we learn that Personal Information of persons under 18 has been collected on or through the DigitalConch Services, we will take appropriate steps to delete this information.
If you believe that we have inappropriately collected Personal Information from children, please contact us in accordance with clause 7.
6.Updates to Our Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in technology, law, our operations, or any other reason we determine is necessary or appropriate, so please review it frequently. We will indicate on the cover page of this Privacy Policy to indicate the recent most date on which the policy was last updated. Please review this Privacy Policy every time you access or use Service to make sure that you have reviewed the most recent version. We will notify you if there is any substantial change occurs.

我們可能使用蒐集之資訊並提供予我們關係企業或合作、協力廠商,以提供您定製網絡服務並改善您對網絡服務的體驗,包括提供與我們、我們關係企業或合作、協力廠商服務有關之內容推薦、推廣,和其他我們、我們關係企業或合作、協力廠商希望您會發現的相關內容(包括但不限於廣告、營銷資訊、活動訊息通知及與您發展各式商業關係等商業訊息傳遞寄發);另我們也可能會定期向您發送與網絡服務相關的宣傳材料或通知。
7.用於統計與分析:

您在執行遊戲服務時,我們將會自動蒐集您使用設備之相關資訊,並作為您個人遊戲習慣及消費行為分析之用,以改善服務、設計會員活動、遊戲內容優化、行銷活動、研發新產品與服務等之依據。並且,我們針對您申請遊戲帳號時所取得的資料,以及站內瀏覽時伺服器所產生的紀錄,將不定期進行總體會員行為分析與統計,惟此處之分析不會針對個人行為進行。

8.用於會員服務
我們將利用您所提供之各項資料提供予您各項服務及福利,具體包括:

當您使用我們網站、應用程式(APP)與其所附屬網站服務,您可能會收到相關電子報。若您欲取消訂閱,請洽我們客服或線上回報系統與我們聯繫。
(2)線上活動、現場活動、賽事活動
(3)虛擬、寶物及贈品寄送
於交寄相關商品時,將您的個人資料利用於交付給相關物流、郵寄廠商用於物品寄送之目的。
(4)我們使用此資料用於您使用剪貼簿功能及與其他玩家的聊天傳遞,以便在遊戲中進行社交,促進您與其他玩家的交流。
(5)其他會員服務
我們將利用您所提供之各項資料提供其他各項會員服務,包括我們所提供的服務及產品之市場研究報告、定期通訊、活動邀請、市場訊息等。

基於政府單位之通知或遵守可適用之法令,我們將收集或處理您的個人資料。
10.隨著公司的轉變與成長,我們可能買賣公司、子公司、產品或資產。在這些交易中,客戶資料通常屬於所移轉商業資產的一部分,若我們進行某一商業交易的轉移作業時(例如被其他公司合併、購併或出售產品或資產的全部或部分),您的個人資料將可能被隨同移轉;惟限於與該經營權轉換服務相關之個人資料。

C002 辨識財務者:如銀行帳戶之號碼等。
C003 政府資料中之辨識者:如身分證統一編號等。
C011 個人描述:如年齡、性別、出生年月日、國籍、聲音等資訊。
C035 休閒活動及興趣:如嗜好、運動等資訊。
C036 生活格調:如使用消費品之種類及服務之細節等資訊。
C038 職業:如司機、校長、老師等職業資訊。
C064 工作經驗:如以前的工作、服役情形等工作資訊。
C132 未分類之資料:如檔案、報告等資訊。
2.為了向您提供服務,根據我們所提供不同服務目的,我們可能蒐集和使用下列種類之資訊(以實際取得者為限):
(1)會員資料
您申請使用我們的服務,應依申請流程,於遊戲網站或遊戲內登錄與身份證明文件相符之個人資料,包括姓名、暱稱、身分證字號、性別、生日、手機號碼、電子郵箱地址、居住地區、語言、通訊地址等相關資料,並設定您的帳號密碼,以便於日後登入使用會員的各項服務。
(2)支付或交易服務之資訊
如您選擇使用支付或交易服務,將會依照您所使用的交易形態蒐集訂單相關資料(如商品或服務資訊、訂單編號、訂單時間、交易金額等),以確保交易完成與後續相關服務(如交易狀態確認、物流、售後與客服服務等)。
(3)線上活動、現場活動、賽事活動之資訊
您若參加我們舉辦之線上、線下活動或網路調查而提供個人資料等相關資料時,亦將一併受到隱私權政策之保護。
(4)使用服務之資訊
為維持遊戲運作和服務品質,亦可能蒐集您的電腦硬體、軟件和行動電話裝置的資料、行動裝置及連線環境相關之資訊,包括您的IP位置、產品型號、作業系統、網路服務提供者、瀏覽器類型、登入時間、使用時間、網站地址/紀錄等軌跡資料,及遊戲內容/設置、遊戲使用數據、購買紀錄、獎品紀錄、與玩家間之關係等。
(5)設備使用權限
部分服務需您同意提供設備機型、存儲、操作系統及版本、客戶端版本、設備解析度、包名、設備標識符(Android ID/SN/IDFA/IDFV/MAC 地址/ IMEI)、軟體安裝列表、軟硬體資訊、IP地址、語言、網路及網路類型等設備資訊。我們收集上述資料主要是為了提供的基本服務、基礎功能及改善我們的服務品質;為了其他服務目的,我們可能需要獲取包括但不限於如下設備資訊之相關權限與功能:
i.通話管理/wifi連線權限
允許開通連線服務的管理功能,利於判斷連線狀況與連線障礙排除。
ii.儲存空間存取權限
允許使用裝置存儲空間,以便下載並保存內容,或者通過緩存來實現相應服務等功能。
iii.設備資訊權限
允許獲取設備唯一性標示資訊以瞭解產品適配性、識別異常狀態以及保障相關服務的網路及運營安全。
iv.相簿、相機(攝影機)權限
能夠上傳、拍攝(錄製)或是選取相簿中照片、圖片、影片,實現上傳、發布等功能。
v.通訊錄權限
可以獲取您的通訊錄中的資訊,以便提供好友狀態查詢、邀請、分享功能。
vi.麥克風和語音相關權限
允許開通連線服務的管理功能,利於判斷連線狀況與連線障礙排除。
vii.位置權限
我們可以獲取設備位置資訊,以便讓與附近的使用者進行互動或是針對特定地點向您推送資訊。
viii.日曆管理的權限
可以獲取您的日曆,以便為您快速提供提醒、特定日期的標註功能。
若您需要關閉這些功能權限時,多數移動設備皆可滿足此類需求,相關操作方式請參考或聯繫您移動設備的服務商或生產商說明。若您關閉上述任一權限即代表取消了授權,我們也無法透過權限授權繼續收集和使用相關資訊與功能;同時也無法為您提供該權限所對應的服務,因此可能將導致您無法使用相關服務。
(6)客戶服務之資訊:
您聯繫客服時(包括提出售中售後申請、個人資訊保護投訴、建議、其他客戶投訴和需求等),可能需要您提供必要的個人資料以驗證您的身分。為保障帳號與系統安全,我們可能還會保存相關聯繫方式(用戶聯繫時所提供的聯繫方式)、相關的通信/通話記錄和內容、需求相關聯的其他必要資訊,或記錄相關問題的處理方案及結果。
(7)Cookies:
Cookies可以在您重回網站時記住您的偏好及使用習慣,且自動調整顯示的內容以改善您的用戶體驗。我們可能使用Cookies蒐集之資料包含:網站管理、活動紀錄、網站使用動態等。若您不願接受Cookies的寫入,可以透過您的瀏覽器設定變更Cookies設置或設定隱私權等級為高,不過請您注意,關閉Cookies將可能導致網站部分功能無法正常執行。
(8)瀏覽網頁之資訊:

除了您直接提供之個人資料之外,您也可能在我們合作廠商處主動提供個人資料,並在您同意或為履行契約目的前提下,將您的個人資料提供予我們。若您於參與我們之服務活動時連結第三方之服務,我們可能蒐集您於該第三方服務之相關資訊。這些資料只會在您同意或為履行契約的服務範圍內利用及處理,不會用於其他用途。
3.特殊或具敏感性的個人資料
我們不會要求您也請您不要提供特殊或具敏感性的個人資料給我們,例如您的病歷、醫療、政治、宗教、哲學信仰、種族、性取向、犯罪紀錄或基因等。
4.您可以自由選擇是否提供您的個人資料給我們,但請您知悉,如未提供足夠資料者(除本條第3款載明的無需提供的特殊或具敏感性的個人資料),部分服務將無法為您提供,敬請見諒。建議您提供完整的個人資料並隨時更新,若因您未提供完整且確實的個人資料,造成您或第三人發生損害時,您應自行負擔一切責任。
四、利用之期間、地區、對象及方式
1.利用期間:
(1)個人資料將於我們服務之營運期間內使用,除法令另有規定者外,至您要求停止使用或該服務終止之日。
(2)依相關法令所規定、因執行法定業務所必須之保存期間或依個別契約就資料之保存所定之保存年限(上開期間或保存年限,以最長者為準)。
2.利用地區:
(1)臺灣及提供我們網站、應用程式(APP)與其所附屬網站服務之地區。
(2)您之個人資料將用於全球。您應知悉,當您將個人資料提供予我們時,您的個人資料皆將可能在我們位處各國的關係企業、服務供應商、經授權的第三方廠商和承包商間進行跨境傳輸、儲存及處理利用;上述跨境傳輸、儲存及處理利用行為皆將遵循本協定及各國或地區個人隱私及資訊安全之相關法令要求。
3.利用對象:
(1)我們、我們關係企業或合作、協力廠商及其人員(指任何股東、董事、顧問、高級職員、僱員、僱員或其他人員,以及其他專業、財務、法律或會計顧問)。
(2)依法律規定或經法律授權之公務及非公務機關。
(3)其他經您同意之對象。
(4)我們所使用之社群媒體或軟體服務供應商(例如:Facebook、LINE、Instagram、YouTube、Discord、Google等)。
(5)除法令另有規定者外,我們將僅供您同意之服務目的及我們內部在相關連之範圍內使用,不會任意將您提供的個人資料轉供其他第三人或移作其他目的使用。
4.方式:
符合個人資料保護相關法令及本隱私權政策,以自動化或其他非自動化之機器或載具為蒐集、處理、國際傳輸及利用。
五、您得行使之權利及方式
1.依據個資法第3條規定,您就我們保有之您的個人資料得行使下列權利:
(1)查詢或請求閱覽。
(2)請求製給電子版複製本。
(3)請求補充或更正。
(4)請求停止蒐集、處理或利用。
(5)請求刪除。
以上權利,若因您不符合我們申請程式或法令另有規定時,將會受到限制。提請知悉,若您就您的個人資料向我們查詢、請求閱覽個人資料或製給電子版複製本時,我們將酌收必要成本費用。
2.您如欲行使上述權利,您可通過privacy@digitalconch.com與我們聯繫並進行申請。請您知悉,為保護您的隱私,申請時您需填具申請檔,我們可以向您請求提供可資確認之身份證明文件,因您未提供或提供不實數據情形時,以致於無法確認您的身份真實性的,我們將無法處理您的請求。若委託他人代為申請者,應出具委任書,並提供本人及代理人可資確認之身份證明文件。
六、您應提供正確的個人資料
您得自由提供個人資料時,若不提供,將對您權益所生之影響。所有關於您的個人資料之欄位請務必確實填寫,若您無法提供完整且確實的個人資料,將影響我們和您的聯繫、完成交易、提供服務、身份驗證或處理消費、交易或客訴問題或其他業務。建議您應提供完整的個人資料及隨時更新。若因您未提供完整且符合真實之個人資料造成對您及第三方發生損害時,您應負擔完全法律責任,如造成我們之損失,亦應對我們負損害賠償責任。
七、個人資料之維護
1.關於您的個人資料,我們將盡力以適當、合理之技術及措施維護您的資料安全,並依相關法令辦理安全維護事項,防止您的個人資料被竊取、竄改、毀損、滅失或洩漏。
2.除本政策、其他適用之隱私政策修訂中已有說明,或有下列情形外,我們不會向任何其他人公開您的個人資料,或與之分享:
(1)經由合法之途徑。
(2)為保護我們網站或產品各相關單位之權益。
(3)配合司法單位合法之調查。
(4)配合相關職權機關依職務需要之調查或使用。
(5)基於善意相信揭露為法律需要,或為維護和改進網站服務而用於管理。

(7)在緊急情況下為維護其他用戶或第三人之人身安全。
